The High Court in Dar es Salaam resumed the treason trial of Chadema national chairperson Tundu Lissu on Monday, following an 88-day pause.
The trial’s resumption was marked by a procedural dispute over the use of a concealed prosecution witness, known as P11.
The hearing, presided over by a three — judge panel led by Judge D. Ndunguru, saw Lissu, representing himself, object to the state’s plan to present the protected witness from a concealed booth, or kizimba. Prosecutors argue that this arrangement is permitted under the 2025 Witness Protection Rules and an existing court order.
State Attorney Nassoro Katuga told the court that the measure was necessary and lawful, emphasizing the importance of witness safety in serious criminal cases.
However, Lissu challenged both the legality and fairness of the setup, arguing that the booth prevented the court from properly assessing the witness’s credibility. Lissu also questioned how the witness protection order was granted, stating that prosecutors failed to name the witnesses or specify the threats they faced.
He further argued that the Witness Protection Rules lack proper legal grounding, as the parent legislation was never published in the Government Gazette or tabled in Parliament.
Additionally, Lissu raised concerns about his treatment in custody, alleging that prison officials were monitoring confidential conversations with his lawyers and barring visits from Chadema leaders.
The judges adjourned proceedings to Wednesday, 11th February, to rule on Lissu’s objection to the use of a concealed witness.
The outcome of this decision could determine whether key prosecution evidence is admitted. For Lissu, the trial marks another chapter in a legal battle that has spanned over 307 days of custody, with only 15 days of hearings conducted to date.
